After being admitted to practice law in January 1997, Mr. Spencer worked for New York City civil litigation firms where he learned all aspects of state and federal litigation, practicing in the five boroughs of NYC. In 2002, Mr. Spencer defeated George Lucas creator of Star Wars in a highly publicized First Amendment free speech case in federal court in California, Lucasfilm Ltd. v. Media Market Group, Ltd., 182 F. Supp. 2d 897 (N.D. Cal. 2002) where Mr. Spencer successfully argued that the animated pornographic comedy Starballz was a parody of Star Wars like Mel Brooks’s movie Spaceballs that was protected under the 1st Amendment. Later that year, Mr. Spencer became the first litigant to prevail in New York Supreme Court in 9/11 litigation before moving to Colorado to cofound the Colorado Tennis Center. In 2003, after NBA star Kobe Bryant was arrested for sexual assault in Eagle, Colorado, Evan invented the Pre- Sexual Agreement, a contract analogous to a pre-nuptial agreement that was parodied on Chappelle’s Show on Comedy Central as the “Love Contract” and reported by the media internationally including Playboy magazine and Sports Illustrated.
In 2012, Mr. Spencer filed a class action against New York City restaurants, bars, and night clubs that violated consumer protection laws by charging automatic gratuities, Dimond v. Darden, et al. 13 Civ. 5244 (KPF) (S.D.N.Y. Jul. 9, 2014). Evan was interviewed in Times Square on the evening news and the case received national media attention, advised the public of this unlawful practice, and stopped most businesses from continuing the illegal policy. In 2013, Mr. Spencer’s lawsuit against Match.com, Avalos v. IAC, et al. 13-CV-8351 (JMF) (S.D.N.Y. Oct. 30, 2014) was responsible for exposing the fake profiles and catfish scams that exist on IAC Interactive’s dating web sites, where thousands of members have been scammed out of millions of dollars. From 2014 – 2020, Mr. Spencer instituted several civil rights cases in Nebraska federal and state court on behalf of Nebraska businessman Shane Harrington that resulted in the formation of five successful gentlemen’s clubs in Nebraska including Midwest Girls Club and Club Omaha (www.ClubOmaha.club). These cases included Harrington, et al. v. City of Hastings, et al. 4:15- cv-03152 (JMG)(D. Neb. 2015) and Harrington, et al. v. City of Omaha, et al. 8:20-cv-00412 (BCB)(D. Neb. 2020), where Plaintiffs prevailed.
In 2022, Mr. Spencer filed two high profile cases. The first was against the NFL and Metlife Stadium for false advertising, Suero v. NFL, et al. 22-cv-31 (AJN) (BCM) (S.D.N.Y. Jan. 28, 2022). This case was successful as Defendants rewrote their entire website in response to the lawsuit by removing all of the false advertising. The second was Johnson v. Musk, et. al. 1:22- cv-05037 (AKH) (SDNY 2024) over Elon Musk’s manipulation of Dogecoin cryptocurrency, a case that was dismissed in a controversial decision by the district court in August 2024. Mr. Spencer is preparing to file new class actions in 2024 and 2025 that will benefit millions of property owners, business owners and consumers throughout the United States.
Evan’s entertainment career began as a child actor in the televised movie “The Most Wanted Man.” Evan produced and co-directed the acclaimed documentary Inside Tennis for the tennis channel that has been broadcast hundreds of times since 2003. Evan Spencer was born in the summer of 1969 at St. Lawrence Hospital in Bronxville, New York. His father was a disabled WW2 veteran from Brooklyn and his mother grew up in Brooklyn as well. Evan was educated in Westchester County, New York at Davis Elementary and Scarsdale High school (the #1 public high school in the United States at that time) where he was the only student to graduate after only 3 years at the age of 16. Evan received his Bachelor’s degree in Philosophy from the State University of New York at Purchase in 1992 and his law degree from PACE University School of law in White Plains in 1996. Evan is an avid skier, tennis player, golfer, martial artist and ACBL Regional Duplicate Bridge Master who often attends concerts and sporting events and travels frequently domestically and abroad. Mr. Spencer is an entrepreneur who has close to a half-century of experience with start-up companies, beginning with a childhood company in the 1970’s that washed cars, shoveled driveways and raked leaves.
